Easy.
Here's what you do.
Step 1: Write a letter like this: Re: Account# Creditor Name, etc.
Dear (collection agency),
This letter is your notice to cease all telephone contact with me regarding this debt. All future communications regarding this debt will be by mail only. This is in accordance with the FDCPA, and you are bound by law to follow it.
Thank you, Your Name
Step 2: Mail it to the collections agency via certified mail, so you can get a receipt and prove they received it. Or FedEx it. :) That's it! According to the Fair Debt Collecting Practices Act (FDCPA), you are legally entitled to tell a credit collections agency to cease any and all communications with you, BUT, you need to be careful here. If the debt is still within the statute of limitations and you tell them to leave you alone completely, you will give the collector no choice but to sue you. Your only goal is to tell them to simply deal with you via mail and not call you all the time. After that, you can try the debt validation technique, or if you don't feel you'll have the time and tenacity to keep up with it, you may want to look into one of the few reputable credit repair attorneys I've been able to find. |
